Board of Trustees Meeting on May 3, 2010

GENOA CHARTER TOWNSHIP
REGULAR MEETING
MAY 3, 2010
6:30 p.m.

MINUTES

Supervisor McCririe called the regular meeting of the Genoa Charter Township Board to order at 6:30 p.m. The Pledge of Allegiance was then said. The following persons were present constituting a quorum for the transaction of business: Gary McCririe, Paulette Skolarus, Robin Hunt, Todd Smith, Jean Ledford, Steve Wildman and Jim Mortensen. Also present were Township Manager Michael Archinal and five persons in the audience.

A Call to the Public was made with no response.

Approval of Consent Agenda:
Moved by Smith, supported by Ledford, to approve all items listed under the consent agenda as requested. The motion carried unanimously.

1. Payment of Bills

2. Request to approve minutes: 4-19-10

3. Consider approval of security cameras and paving for the Genoa Athletic Field Pavilion.

4. Consider approval of a proposal from Tom Rogers Asphalt for repairs at the Nielsen Fire Station.

5. Consider approval of a proposal for the installation of Township entrance signs.

Approval of Regular Agenda:
Moved by Ledford, supported by Wildman, to approve for action all items listed under the regular agenda as requested. The motion carried unanimously.

6. Discussion regarding the Dillon Water Agreement PILOT charge.

Mr. John Johnson addressed the board concerning the PILOT charges that have been incurred over the past 18 years. Johnson - Originally there were 89 units that were involved in the first agreement with the City of Brighton. That system costs the city zero dollars since the state provided over $750,000.00 for the project. In the end the state paid more than one million dollars. The well on Challis Road was at one time in Genoa Township and the Township gave it to the city. We already pay an additional 10% for our water usage. We should not be charged $100.00 just because we are outside of the city.

Archinal - There is some question regarding the legality of such charges. A township law E-Letter speaks to a case in Grand Ledge that is on point. Basically if there are premiums charged to customers outside a jurisdiction those charges have to be based upon the incremental added cost of providing the service. They cannot be arbitrary.

Moved by Smith, supported by Hunt, to authorize the manager to approach the City of Brighton to discuss the concerns raised by Mr. Johnson in the hopes of settling the matter amicably. The motion carried unanimously.

7. Consider first reading of an ordinance to designate Genoa Charter Township as an enforcing agency for the Michigan Construction Code.

Moved by Ledford, supported by Mortensen, to approve the first reading of Ordinance 100517 as presented. The motion carried by roll call vote as follows: Ayes - Ledford, Smith, Hunt, Wildman, Mortensen, Skolarus and McCririe. Nays - None. Absent - None.

8. Discussion regarding ribbon cutting ceremony for the Genoa Athletic Field Pavilion.

It was the consensus of the board to hold a ribbon cutting ceremony on June 7, 2010 at 6:00 p.m. to dedicate the new gazebo and soccer fields. This ceremony will honor Mr. Un Chong and thank Mrs. Christine Vogt for her generous donation on behalf of her husband Mr. Chong.

The board approved the purchase of four picnic tables and three receptacles at a total cost of $4,840.00 for the completion of the gazebo.

The regular meeting of the Genoa Charter Township Board was adjourned at 7:10 p.m.
