MINUTES
Chairman Mike Howell called the regular meeting of the Zoning Board of Appeals to order at 6:30 p.m. at the Genoa Charter Township Hall. The Pledge of Allegiance was then said. The following board members were present constituting a quorum for transaction of business: Steve Wildman, Mike Howell, Joe Perri, and Kevin Brady. Also present was Township staff member Adam Van Tassell and approximately 4 persons in audience.
The members induced themselves to the public.
Moved by Brady, supported by Wildman, to approve the agenda as presented. Motion carried unanimously.
09-09 A request by Ralph Schuster, Section 30, 6138 Sundance Trail, for a side yard variance to construct a detached accessory structure.
A call to the public was made with the following response: Norman Boyer, 6122 Sundance Trail, "We found this lot while we were on vacation in the area and built the house in 1978. We liked that area due to the stately homes. When we purchased this lot, we spoke to the owners and they said that no detached structures were allowed according to the covenants. I had to purchase an additional place to store my antique cars. Since we have lived there, there have only been 3 to 4 owners and there has never been a problem. I would be able to see this right out of my house and I would be greatly offended.
Doug Rearrick, 6154 Sundance Trail, "I have lot 57,58,59,60 and own 10 acres behind and I own an additional 30 acres behind that. There is no unique nature to this lot. I would like to ask you what is the hardship to this lot. If it is a financial constraint, does that serve as a hardship.
Moved by Brady, supported by Perri, to deny case # 09-09 located at 6138 Sundance Trial, for the request of a 10-foot side yard variance to construct a detached accessory structure due to no practical difficulty. Motion carried unanimously.
Moved by Perri, supported by Brady, to approve the April 21, 2009 Zoning Board of Appeals minutes. Motion carried unanimously.
