MINUTES
Vice Chairwoman Barb Figurski called the regular meeting of the Zoning Board of appeals to order at 6:30 p.m. at the Genoa Township Hall. The Pledge of the Allegiance was then said. The following board members were present constituting a quorum for transaction of business: Steve Wildman, Barb Figurski, Kevin Brady and Joe Perri. Also present was Township staff member Adam VanTassell and two persons in the audience.
Moved by Brady, supported by Wildman, to approve the agenda as presented. Motion carried unanimously.
A call to the public was made for agenda items with no response.
- 09-03…A request by Beverly Cooley, Section 1, 65 Kellogg Road, for a variance to create a nonconforming lot.
Beverly Cooley is present to address the Commission. She explains that Public Act 116 allows them to split 2 acres without it affecting what they do. Mr. Brady states that the hardship in this case is economic and it does not meet the requirements of the ordinance. Mr. Brady states that they don't have the tools in the ordinance to grant the variance.
A call to the public was made at 6:48 pm with no response.
Moved by Brady, supported by Perri to deny the variance request for case #09-03, petitioned by Beverly Cooley, Section 1, 65 Kellogg Road, for a variance to create a nonconforming lot citing lack of practical difficulty.
Motion carried unanimously.
Moved by Perri, supported by Brady to approve the minutes of the January 21, 2009 meeting. Motion carried unanimously.
Moved by Wildman, supported by Perri to adjourn the meeting at 6:51 p.m. Motion carried unanimously.
