Board of Trustees Meeting on February 5, 2001

Agenda:

1. Request for approval of the environmental impact assessment, corresponding to a rezoning request for a 7.317 acres parcel from CE (Country Estates) to RR (Rural Residential) for property located at the intersection of Coon Lake Rd. and Pardee Lake Road as petitioned by Enrico Ingratta and recommended by the Planning Commission 11-13-00.

A. Disposition of impact assessment.

2. Request for approval of the Southeast Livingston Greenways Plan and Summary Report dated October 2000 and recommended by the Planning Commission on 01-08-2001.

3. Request for approval of the Cunningham Lake Road Improvements as discussed the Livingston County Road Commission letter dated 12-30-00 and recommended by the Administrative Committee.

4. Request for approval of a bid for the Brighton Road bike/walk path to be constructed this spring along Brighton Road from the Brighton City limit to the entrance to Rolling Meadows Subdivision.

Minutes:

A regular meeting of the Genoa Township Board was called to order by Supervisor McCririe at 7:00 p.m. at the Genoa Township Hall. The Pledge of Allegiance was then said. The following board members were present constituting a quorum for the transaction of business: McCririe, Skolarus, Hunt, Ledford, and Smith. In addition the following persons were present: Township Manager Michael Archinal and eight persons in the audience.

Moved by Ledford, supported by Hunt, to amend the Agenda adding the following three petitions: 5. Request for approval of the reappointment of the Board of Review. 6. Acceptance of the resignation of Kathy Robertson as Trustee to the board and the appointment of Anthony Combs to fill the vacancy. 7. Discussion of pending litigation. The amended agenda was voted and carried unanimously.

A Call to the Public was made with the following response: Larry Julian - I am a candidate for the Michigan Senate seat that was recently vacated by Mike Rogers. Julian advised the board that he served as a Michigan State Police Officer for 27 years and was elected twice to the state house.

1. Request for approval of a bid for the Brighton Road bike/walk path to be constructed this spring along Brighton Road from the Brighton City limit to the entrance to Rolling Meadows Subdivision.

Peter Finkbeiner of Boss Engineering presented the bids for the bike path. He recommended the low bidder, Summit Transportation, for the project construction. Summit failed to include $12,000.00 in soil removal in their bid. Finkbeiner asked that the board approve $105,000.00 for the project. It was the consensus of the board that the bike path should be constructed and that condemnation proceedings be instigated either by the Livingston County Road Commission or the Township Attorney on behalf of Genoa Township for the property belonging to Haase and Blackwell. The bike path would be constructed from the Brighton City limit to the entrance to Rolling Meadows Subdivision, just west of Maltby Middle School.

Moved by Skolarus, supported by Ledford, to approve the impact assessment dated 09-25-00 as submitted. The motion carried unanimously.

B. Disposition of rezoning request.

Moved by Ledford, supported by Smith, to approve the rezoning request as submitted. The motion carried unanimously.

3. Request for approval of the Southeast Livingston Greenways Plan and Summary Report dated October 2000 and recommended by the Planning Commission on 01-08-2001.

Moved by Ledford, supported by Hunt, to approve the plan and summary report as submitted. The motion carried unanimously.

4. Request for approval of the Cunningham Lake Road Improvements as discussed in the Livingston County Road Commission letter dated 12-30-00 and recommended by the Administrative Committee.

Moved by Hunt, supported by Smith, to allow the Township to enter into an agreement with the LCRC for $45,520.84 and approve the draft of 01-29-00 addressed to George Masinda. The motion carried unanimously.

5. Request for approval of the reappointment of the Board of Review.

Moved by Skolarus, supported by Ledford, to reappoint Ron Markin, Nancy Litogot and James Heaslip to the Board of Review. The motion carried unanimously.

6. Acceptance of the resignation of Kathy Robertson as Trustee to the board and the appointment of Anthony Combs to fill the vacancy.

Moved by Ledford, supported by Skolarus, to regretfully accept the letter of resignation from Kathy Robertson dated 01-31-01. The motion carried unanimously.

Moved by Hunt, supported by Smith, to appoint Anthony Combs to the position of Trustee to the Genoa Township Board. The motion carried unanimously.

7. Discussion of pending litigation.

Moved by Ledford, supported by Hunt, to adjourn to executive session to discuss current litigation involving the Mr. Gunstello and the Tax Tribunal. The motion carried by roll call vote as follows: Ayes - Ledford, Smith, Hunt, Skolarus and McCririe. Nay - None. Absent - Mortensen.

Administrative Business:

It was the consensus of the board to make a grant application with the county for a special cleanup of large household items and to coordinate that project with the spring yard cleanup.

Moved by Hunt, supported by Ledford, to approve for payment vouchers totaling $286,206.97. The motion carried unanimously.

Moved by Ledford, supported by Smith, to approve the Minutes of the 01-10-01 regular meeting of the board as presented. The motion carried unanimously.

The regular meeting of the Township Board was adjourned at 8:25 p.m.
