MINUTES
Supervisor McCririe called the regular meeting of the Genoa Charter Township Board to order at 6:30 p.m. The Pledge of Allegiance was then said. The following persons were present constituting a quorum for the transaction of business: Gary McCririe, Paulette Skolarus, Robin Hunt, Todd Smith, Steve Wildman and Jim Mortensen. Also present were approximately 15 persons in the audience.
A call to the public was made with the following response: Don Green - The ZBA agenda was not published and it was not on the web site as of 4o'clock this afternoon. McCririe - I will check on the publication. Robert Stock - With regard to the rezoning, I did not get a mailing. Everyone does not subscribe to the Brighton Argus and you should be doing a better job of informing the public of meetings. McCririe - The township board meets the first and third Monday of the month. There is a posting on the bulletin board outside the township hall and the Agenda is on the web site. Ed Luff - With regard to the weed control on Lake Chemung - weeds are now worse than ever on the lake. Wildman - The Lake Chemung Riparian Association meets once a month at the International Society. There are certain places on the lake where we are not allowed to place chemicals. Your concerns should be addressed to the Riparian Association. Please plan on attending the next meeting.
(Note: A further review of the comments made at the call to the public determined that the Agenda for the ZBA meeting was published on 08/11/2006 in the Argus/Press and that Mr. Green was personally mailed two notices of the 08/22/06 meeting.)
Approval of Consent Agenda:
Moved by Smith, supported by Mortensen, to approve all items listed on the consent agenda as presented. The motion carried unanimously.

Approval of Regular Agenda:
Moved by Hunt, supported by Smith, to approve for individual action all items listed on the regular agenda. The motion carried unanimously.
5. Public Hearing No. 1 for Pardee Lake Weed Control.
A Call to property owner and the public was made with the following response: Randy Lowe - I own two parcels on Pardee Lake. They are under separate tax codes and I do not feel that I should have to pay two assessments when the one parcel is not buildable and only 15' across. McCririe - We will review your claim with the assessing department.
6. Request for approval of Resolution No. 2 (to proceed with the Project, approve the plans and details and direct the preparation of the Special Assessment Roll and Schedule the second public hearing).
Moved by Smith, supported by Mortensen, to approve Resolution No. 2 establishing the second public hearing for Monday, Sept. 18, 2006 at 6:30 p.m. This action is subject to a review by the township attorney concerning the combining of the lots into one tax identification number or some other solution. The motion carried by roll call vote as follows: Ayes - Smith, Hunt, Wildman, Mortensen, Skolarus and McCririe. Nays - None. Absent - Ledford.
7. Public Hearing No. 2 for the purpose of considering amendments to the Zoning Ordinance text to establish the Genoa Town Center Overlay District.
A call to the public was made with the following response: Don Green - Last September 55 of the 70 persons in attendance at the public hearing opposed the rezoning. You are rezoning property for a maximum density on small lots and your actions are not appropriate. If I hadn't raised concerns, you would have allowed 45' buildings on Lake Chemung. McCririe - We held many informational meetings since that time to inform our residents of our intentions. Do any of the board members have any financial interest in this property? I know that several of you have real estate licenses. Has any developer submitted plans as yet? McCririe - No developer has submitted any plans, however there are in excess of 40 owners and many of the sites are already built upon.
Moved by Skolarus, supported by Smith, to approve the text amendments as presented. The motion carried unanimously.
8. Public Hearing No. 3 on a proposed Zoning Ordinance Map Amendment rezoning 49 parcels to the Genoa Town Center Overlay District.
A Call to the public was made with no response.
Moved by Skolarus, supported by Wildman, to approve the Zoning Map amendment as presented, excluding the Harvey and Visger parcels. The motion carried unanimously.
Smith advised the board that as a result of the parks and recreation millage failure, the City of Howell will be asking for additional funds to continue the recreational services offered to township residents.
The public hearing and regular meeting of the Genoa Charter Township Board was adjourned at 7:10 p.m.
